Terms of Service

These Terms of Service ("Terms") govern your access to and use of worksheetgeek.com and the Worksheet Geek service (the "Service"). "Worksheet Geek," "we," "us," and "our" refer to the operator of the Service. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and Authority
You must be at least 13 years old, or the minimum age required to consent to online services where you live, to use the Service. The Service is intended primarily for teachers, tutors, parents, and other adults. If you use the Service on behalf of a school, organization, or other entity, you represent that you have authority to bind that entity to these Terms.
Children under 13 must not create accounts or submit personal information. The Service is not designed for direct use by young students.
2. Accounts and Google Sign-In
Access to some or all features requires signing in through Google. You are responsible for maintaining the security of your Google account and for activity conducted through your Worksheet Geek account. You must provide accurate information and promptly notify us if you believe your account has been compromised.
You may not share accounts, impersonate another person, create accounts through automated means, or attempt to avoid account or usage restrictions.
3. The Service
Worksheet Geek uses artificial intelligence to create educational materials based on information and instructions you provide. Features, output formats, usage allowances, models, availability, and functionality may change over time.
We may modify, suspend, restrict, or discontinue any part of the Service. We do not guarantee that the Service or any particular feature will always be available, uninterrupted, secure, or error-free.
4. AI-Generated Content
Artificial intelligence can produce inaccurate, incomplete, biased, unsuitable, or offensive content. Generated materials may contain factual, mathematical, grammatical, pedagogical, or formatting errors. They are not guaranteed to align with any curriculum, law, school policy, accessibility standard, or educational requirement.
You are solely responsible for reviewing, editing, fact-checking, and approving all generated content before using, distributing, or relying on it. Worksheet Geek is a drafting aid and does not replace professional judgment, qualified instruction, legal advice, medical advice, psychological advice, special-education assessment, or safeguarding obligations.
You must ensure that generated content is age-appropriate, accurate, accessible, non-discriminatory, and suitable for your learners and context.
5. Your Inputs and Student Information
You retain any rights you have in information, instructions, and materials you submit ("Inputs"). You grant us and our service providers a worldwide, non-exclusive license to host, transmit, process, reproduce, and use Inputs only as reasonably necessary to provide, maintain, secure, and improve the Service and comply with law.
You represent that you have all rights and permissions necessary to submit your Inputs and that doing so does not violate law, confidentiality duties, intellectual property rights, privacy rights, school policies, or contracts.
Do not submit personally identifiable student information, education records, health or disability information, safeguarding information, passwords, financial information, government identifiers, or other sensitive personal information. You are responsible for complying with applicable student privacy and education laws, including FERPA, COPPA, provincial or state education laws, and institutional policies where applicable.
6. Generated Output and Intellectual Property
Subject to these Terms and applicable law, you may use, edit, reproduce, print, and distribute generated output for lawful educational and personal purposes. Because AI systems may produce similar or identical content for different users, generated output may not be unique and may not qualify for intellectual property protection.
We do not guarantee that generated output is original or that it does not resemble or infringe third-party materials. You are responsible for reviewing output and obtaining any permissions needed for your intended use.
The Service itself, including its software, design, branding, interfaces, and non-user content, is owned by Worksheet Geek or its licensors and is protected by applicable intellectual property laws. Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, lease, or create derivative works from the Service.
7. Acceptable Use
You must not use the Service to:
- Break any applicable law, regulation, or court order.
- Infringe intellectual property, privacy, publicity, confidentiality, or other rights.
- Generate or distribute abusive, exploitative, discriminatory, defamatory, fraudulent, or unlawful material.
- Create sexual content involving minors or content that exploits or endangers children.
- Facilitate cheating, academic dishonesty, deception, or impersonation.
- Upload malware, harmful code, secrets, access credentials, or sensitive personal information.
- Probe, scan, disrupt, overload, reverse engineer, or bypass the Service or its security measures.
- Scrape the Service, automate account creation, or use bots except with our prior written permission.
- Avoid, manipulate, or interfere with generation limits, access controls, or payment requirements.
- Resell, sublicense, or commercially exploit access to the Service without our prior written permission.
8. Usage Limits and Fair Use
Free accounts are subject to generation limits, reset periods, and other technical restrictions displayed in the Service. Limits may vary and may change as the Service develops. Unused generations do not carry over unless we expressly state otherwise.
We may restrict or suspend activity that appears automated, abusive, unusually resource-intensive, fraudulent, or intended to bypass limits. Joining a premium waitlist does not guarantee eligibility, pricing, availability, or access to a paid plan.
9. Future Paid Services
The Service does not currently process payments. We may introduce subscriptions or other paid features in the future and may use Stripe or another payment provider. Before charging you, we will present applicable prices, billing intervals, renewal terms, cancellation procedures, refund rules, taxes, and any additional payment terms.
We will not charge you merely for joining a waitlist. You will need to affirmatively purchase a paid service before payment obligations begin.
10. Privacy
Our Privacy Policy explains how we collect, use, share, and protect information. By using the Service, you acknowledge that Policy.
11. Third-Party Services
The Service relies on third-party services, including Google, Supabase, OpenAI, and Vercel. Your use of those services may also be subject to their terms and policies. We are not responsible for third-party services, content, availability, security, or conduct.
12. Feedback
If you provide suggestions, ideas, or other feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, and incorporate that feedback without restriction or compensation to you.
13. Suspension and Termination
You may stop using the Service at any time. You may request account deletion by contacting us.
We may suspend or terminate access, remove content, or restrict features if we reasonably believe you violated these Terms, created risk or legal exposure, misused the Service, failed to pay future charges, or if suspension is needed for security, maintenance, or legal compliance.
Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnity, dispute terms, and accrued obligations.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND SATISFACTORY QUALITY.
We do not warrant that generated content will be correct, original, safe, appropriate, legally compliant, or suitable for any student, classroom, assessment, or educational objective.
Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable consumer law.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKSHEET GEEK AND ITS SERVICE PROVIDERS, LICENSORS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS, OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE OR GENERATED OUTPUT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO WORKSHEET GEEK DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR 50 US DOLLARS.
These limitations apply regardless of the legal theory and even if we were advised that damages were possible. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Worksheet Geek and its service providers, licensors, and representatives from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your Inputs, your use or distribution of generated output, your misuse of the Service, or your violation of these Terms, law, or third-party rights.
This section does not apply to the extent prohibited by applicable consumer law.
17. Disputes and Applicable Law
Before starting formal proceedings, you agree to contact us and attempt in good faith to resolve the dispute informally for at least 30 days. Send dispute notices to worksheetgeek@gmail.com.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. Disputes will be brought in courts with jurisdiction in Ontario, unless mandatory consumer law gives you the right to bring a claim elsewhere. Nothing in these Terms limits rights or remedies that cannot be waived under the laws where you live.
18. Changes to These Terms
We may update these Terms as the Service changes. We will post the revised Terms and update the effective date. If changes are material, we may provide additional notice where appropriate or required. Continued use after updated Terms take effect means you accept them, except where applicable law requires another form of consent.
19. General Terms
These Terms and the Privacy Policy are the entire agreement between you and Worksheet Geek regarding the Service, except for any additional terms presented for future paid features. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain effective.
Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, financing, or transfer of the Service.
